About these terms

AFTERBURN is operated by MAXMARGIN CORP. In these Terms of Service, “AFTERBURN,” “we,” “us,” and “our” refer to MAXMARGIN CORP trading as AFTERBURN. These terms apply to your use of shop.myafterburn.com and purchases through our store, together with our Privacy Policy, Shipping Policy, and Refund Policy.

By using the store or placing an order, you agree to these terms to the extent permitted by applicable law. Nothing in these terms removes rights or remedies that applicable consumer law gives you.

Using the store

You must be legally able to enter into a purchase agreement, or have the permission and supervision of a parent or legal guardian where appropriate. Please provide accurate, complete, and current contact, delivery, and payment information. Keep any account credentials secure and let us know if you believe your account has been used without authorization.

You may not use the store for an unlawful purpose, infringe another person's rights, introduce malicious code, attempt unauthorized access, or interfere with the store's operation.

Products and safe use

AFTERBURN focuses on sports and fitness gear. Product descriptions, available options, and any product-specific instructions appear on the relevant product page. Images and colors may vary with screen settings. This does not affect your right to receive goods that match their description.

Use products only for their intended purpose and follow the supplied instructions and warnings. General information on the store is not individualized medical or training advice. We do not promise a particular fitness result.

Orders and availability

Placing an order is an offer to purchase the items in your order. An automated receipt acknowledges that we received the order; acceptance is confirmed when we confirm dispatch, unless we expressly confirm acceptance earlier. Orders depend on availability and successful payment processing.

If we cannot fulfill an order, need to correct an error, or reasonably suspect fraud, we will contact you using the details you provided. If an order is canceled after payment, we will refund the amount charged for the canceled items and any associated charges that are refundable.

For changes or cancellation requests, contact [email protected] promptly with your order number. We will review the request, but cannot guarantee a change or cancellation after processing or dispatch. Any statutory cancellation right continues to apply.

Prices, currency, and payment

Product prices and checkout charges are in US dollars (USD). If your payment account uses another currency, your provider may apply its own exchange rate or conversion fees.

The price, shipping charge, and any tax or duty collected by the store are shown at checkout before you submit your order. Charges imposed separately by a destination country or carrier may also apply, as explained in our Shipping Policy.

Prices and promotions may change for future orders. If a pricing or description error affects an order, we will contact you about the available options, including cancellation and a refund where appropriate. You must be authorized to use the payment method you provide.

Shipping and returns

We ship to the United States, Canada, and Australia. Orders are usually dispatched within 3 days. Shipping is $5.99 USD for orders below a merchandise subtotal of $39.99 USD, and free for orders of $39.99 USD or more, after discounts and before taxes and shipping.

If there is a problem with a shipment, contact us so we can help resolve it. Nothing in these terms automatically removes our responsibility simply because an order has been handed to a carrier.

Intellectual property and customer content

The AFTERBURN name, logo, store design, and original content belong to us or their respective rights holders. You may use the store for personal shopping, but may not reproduce or commercially exploit protected material without permission or another lawful basis.

If you submit a review or other content, you must have the right to share it and it must be accurate to your experience and lawful. You give us permission to display and reproduce that content in connection with the store and the relevant product. We may remove unlawful, misleading, or abusive content. This provision does not transfer ownership of your content to us.

Shopify and third-party services

Our store is powered by Shopify. Purchases through this store are made directly with MAXMARGIN CORP trading as AFTERBURN, rather than Shopify. Shopify and other service providers help us host the store, process payments, and provide store functions. Their own terms and privacy notices may apply to the services they provide.

Links to third-party websites are provided for convenience. We do not control their content, availability, or privacy practices. Our use of a service provider does not remove obligations we owe to you under applicable law.

Privacy

Our Privacy Policy explains how personal information is handled in connection with the store and how to contact us about your rights.

Consumer guarantees and liability

We do not exclude or restrict liability where doing so would be unlawful, including liability for fraud, willful misconduct, or any obligation that applicable law does not allow us to exclude.

To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the agreement was made, or business losses arising from purchases intended for personal use. These limitations do not override any mandatory rights or remedies available to you.

For Australian customers, our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Applicable law and disputes

These terms are subject to the laws that apply to your purchase, including mandatory consumer protections available under the laws of your place of residence. Nothing in these terms requires you to give up a right to bring a claim in a court or other forum available to you under applicable law.

If you have a concern, please contact us so we can try to resolve it. This does not prevent you from using any dispute resolution or legal remedy available to you.

Changes and remaining provisions

We may update these terms by posting a revised version and its date. Changes apply to future use and orders; they do not retroactively remove rights relating to an existing order. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
